Mistrust and judicial procedure

Abstract

The distrust is an assessment from different characteristics that all human beings would perform before a situation and / or a person. In that process of evaluation of human relations, vices can be generated. The present work shows the revision of the phenomenon of distrust in the judicial procedures for sexual offenses that affect children and adolescents, analyzing their effects on the overabundance of evidence. The methodology used corresponded to a mixed quantitative and qualitative research, consisting of surveys (N=54) and in-depth interviews (N=6) applied to criminal judges from the Metropolitan Region of Chile. The results obtained show deficiencies in various milestones of the judicial process: low qualitative evidence to judge, and overabundance of unnecessary proofs. Finally, characteristics of the phenomenon of distrust, based on deficiencies of the process but also on the moral nature of the crime, would be observed.
